DUI is much more than a traffic violation—even first-time offenders may face time in jail. If you are currently facing drunk-driving charges, you should hire an experienced defense attorney to represent you during this difficult time.
For a first DUI conviction, you could be sentenced to between 10 days to 12 months in jail. In most cases, a first-time offender will spend only 24 hours in jail, with the rest of the jail time suspended or probated. You could also be ordered to pay $300 to $1,000 in fines and perform 40 hours of community service. DUI School, alcohol evaluation and treatment, and the
loss of driving privileges for one year are also potential penalties
.
If you are convicted of a second DUI within five years, the judge may sentence you to between 90 days and 12 months in jail; however, all but 72 hours can be probated or suspended. Fines may range from $600 to $1,000, and you may be ordered to perform 30 days of community service. DUI School, alcohol evaluation and treatment, and an 18-month driver’s license suspension may be ordered for a second conviction. In addition, you may be required to have an ignition interlock device installed in your motor vehicle or to surrender your license plates. Your picture may also be published in the local newspaper.
The penalties for
a third conviction may include between 120 days and 12 months in jail
; all but 15 days can be probated or suspended. You can be ordered to pay $1,000 to $5,000 in fines and perform 30 days of community service. The judge may sentence you to attend DUI School, alcohol evaluation and treatment, and your license may be suspended for five years. You may be ordered to install an ignition interlock device in your vehicle and surrender your license plates. In addition, your photo may be published in the newspaper.
As you can see, the penalties for a DUI conviction are life-altering.
