Georgia DUID-Driving Under the Influence of Drugs

Georgia DUID
When most people think of driving under the influence (DUI), they normally think about alcohol. However, you may be charged with driving under the influence of drugs (DUID) in Georgia. In this case, “drugs” does not refer to just illegal drugs such as marijuana and cocaine. Being under the influence of legal prescription drugs or even over-the-counter medicine such as cough syrup can result in a DUI charge if your driving was impaired. In fact, anything that impairs physical and mental abilities can be classified as a drug. If you are facing a DUID charge, you need to speak to an attorney who has experience in this field right away.

In a drinking and driving case, the law is clear cut: driving with a blood alcohol content of .08% or higher is considered a “per se” offense. Even if the driver’s ability to drive was not affected, he or she will be charged with DUI for being over the legal limit. Driving under the influence of drugs is a little trickier because there is no legal per se level.  The prosecution must use circumstantial evidence, such as the arresting officer’s testimony about how the defendant was driving, how he or she acted, and the results of his or her chemical test.

If convicted of driving under the influence of drugs, the defendant may face the same penalties as a drunk driver.  You may be sentenced to a driver’s license suspension for one year and will be unable to have it reinstated for six months, with no limited driving permit allowed. The judge may also sentence you to jail time, probation, fines, and community service.

There are other side effects from a DUID conviction. Because you are considered a high-risk driver, your insurance company may raise your rates or cancel your coverage. You may also be fired from your job if your employer requires a clean driving record.

While driving under the influence of drugs is a serious crime, an experienced DUI attorney may be able to establish a good defense for your case. Hiring legal representation quickly will allow your evidence ample time to investigate your case and collect evidence that can be used on your behalf.
